What began as a marketing and sales coaching business in 2012 has evolved into an executive-level revenue leadership and strategic hiring support company. As our services and focus expanded, so did our brand. Each shift reflected a natural progression and a step forward. We’ve stayed committed to delivering clarity, impact, and real results at every stage. Today, as Tucci Rue LLC, we use the name Tucci, a name that reflects our family-first mindset. ​

Terms and Conditions 

These Terms and Conditions govern the use of services provided by Tucci Rue LLC, a fractional Chief Revenue Officer (fCRO) company offering Interview-as-a-Service (IAAS) solutions.

 

Legal Protection and Liability

Tucci Rue LLC, including its owners, officers, employees, contractors, affiliates, and family members, shall not be held liable for any direct, indirect, incidental, consequential, or special damages arising out of or related to the use of our services. This includes, but is not limited to, damages related to hiring outcomes, business performance, revenue loss, reputational impact, or any decisions made based on our evaluations or advice. All services are used at the client’s own risk.

All services provided by Tucci Rue LLC are offered on an “as-is” and “as-available” basis without any warranties, guarantees, or representations, express or implied. We do not warrant any specific results, outcomes, or improvements in hiring, revenue, team performance, or business growth. Clients accept full responsibility for how they use our evaluations, insights, or recommendations.

By engaging with our services, clients agree to fully indemnify, defend, and hold harmless Tucci Rue LLC, its owners, employees, contractors, affiliates, and family members from any and all claims, liabilities, losses, damages, legal actions, or expenses including attorney’s fees arising out of or related to their use or misuse of our services.

Clients waive all rights to bring any legal action, including lawsuits, arbitration, or mediation, against Tucci Rue LLC or any of its related parties, in connection with the services provided. Any concerns or disputes must be addressed through informal, good-faith communication. By using our services, clients expressly agree not to pursue any legal recourse now or in the future.

If any provision of these terms is deemed invalid or unenforceable, the remainder shall remain in full force and effect. These terms represent the complete agreement between Tucci Rue LLC and the client regarding liability and legal responsibility.

 

Services and Use of Terms

Tucci Rue LLC provides Interview-as-a-Service (IAAS) evaluations designed to support companies during the final stage of interviews for revenue-impacting roles such as sales, marketing, customer success, business development, revenue operations, and executive leadership. Our evaluations are strategic, experience-driven, and tailored to help hiring managers make more informed decisions at the final interview stage.

Tucci Rue LLC is not a staffing agency, recruiter, headhunter, HR services provider, or employer of record. We do not source candidates, perform background checks, extend offers, negotiate compensation, provide legal or compliance services, or make hiring decisions on behalf of our clients.

​

Our IAAS model is strictly advisory. We evaluate candidates already sourced and screened by the client and provide independent, unbiased insight based on years of executive-level revenue leadership experience. This structure allows us to remain focused solely on candidate quality, free from placement fees or volume-driven incentives.

By engaging with Tucci Rue LLC, clients expressly authorize us to communicate directly with candidates for the purpose of conducting evaluations, interviews, or follow-up discussions as part of our Interview-as-a-Service (IAAS) offering. This may include live interviews, recorded video sessions, email exchanges, or other candidate-facing interactions deemed necessary to complete our assessment. Clients acknowledge that this communication is essential to the integrity of our evaluation process and grant Tucci Rue LLC full permission to engage candidates in a professional and respectful manner.

Our services are non-exclusive and may be offered to multiple clients, including those operating within the same industry or market. We do not provide client-specific territorial exclusivity unless otherwise agreed upon in writing.

To ensure effective service delivery, clients are responsible for providing accurate job descriptions, candidate details, access to interview recordings or live sessions, and prompt communication. Clients must notify Tucci Rue LLC of changes to role requirements, candidate availability, or hiring timelines in a timely manner. Delays or incomplete information may impact our ability to provide effective evaluations.

Tucci Rue LLC does not make or influence hiring decisions. We provide strategic evaluations and advisory feedback, but clients retain full and sole responsibility for all employment-related decisions and outcomes.

Tucci Rue LLC makes no guarantees regarding candidate suitability, performance, retention, or future success. While our evaluations are thorough and rooted in real-world experience, all hiring decisions and results are ultimately at the client’s discretion and risk.

Tucci Rue LLC agrees to treat all client-provided candidate information and internal documentation as confidential. However, clients acknowledge that Tucci Rue LLC is not liable for any unauthorized access, data breaches, or misuse of information occurring outside of our control, including through third-party systems or client-side vulnerabilities.

​​

Clients may not use Tucci Rue’s services or materials for illegal purposes, internal personnel disputes, harassment, or misrepresentation. Any misuse of our services, content, or reputation will result in immediate termination of services and may lead to further legal action.

​​

All materials created, provided, or published by Tucci Rue LLC including but not limited to reports, candidate evaluations, templates, processes, proprietary frameworks, methodologies, written content, digital assets, email content, website copy, landing pages, taglines, social media posts, advertising copy, marketing campaigns, brand language, video or audio recordings, training materials, and any other creative or strategic work are the exclusive and protected intellectual property of Tucci Rue LLC. This also includes all Tucci Rue trademarks and brand assets, such as our business name, logo, domain, website, slogans, visual identity, and branded materials, whether registered or unregistered.

Clients, partners, and any third parties are strictly prohibited from copying, modifying, reproducing, distributing, republishing, sublicensing, creating derivative works from, or otherwise using any part of Tucci Rue’s intellectual property without prior written consent. This restriction applies to all uses, including but not limited to recruiting processes, internal training programs, websites, promotional content, client-facing materials, and business development resources.

Any unauthorized use of Tucci Rue’s intellectual property is considered a direct violation of these terms and will result in immediate termination of services, revocation of access to all materials, and the pursuit of all available legal remedies. This includes, but is not limited to, cease and desist orders, civil legal action, recovery of damages, and injunctive relief. Tucci Rue LLC actively monitors for infringement and reserves the right to enforce its intellectual property rights to the fullest extent of the law in order to protect its business, brand, and affiliated individuals.

Tucci Rue LLC reserves the right to decline or discontinue services at any time, for any reason, including but not limited to misalignment of values, inappropriate behavior, unethical practices, or breach of these terms.

​

Privacy and Confidentiality

All information, materials, and deliverables shared by Tucci Rue LLC, including but not limited to interview evaluations, reports, frameworks, templates, marketing materials, advertising content, website and social media assets, digital tools, and any related documentation, are considered strictly confidential. Clients may use these deliverables solely for internal hiring decisions directly related to the engagement. Disclosure to third parties, competitors, or external vendors is strictly prohibited without prior written consent from Tucci Rue LLC.

Tucci Rue LLC respects and protects the privacy of all clients and complies with applicable data protection laws. Any personal, candidate, or business data shared with us will be handled with discretion and will not be shared, sold, or disclosed externally without the client’s consent, unless required by law. Clients are also expected to uphold the same level of data protection when handling any information provided by Tucci Rue LLC.

Tucci Rue LLC offers Interview-as-a-Service (IAAS) on a per-candidate basis or through custom service packages tailored to each client’s needs. All pricing, including any promotional discounts, will be disclosed and agreed upon in writing prior to the start of service. Any alternative pricing models, such as revenue-sharing agreements, retainers, or subscription plans, must be fully documented and signed by both parties. Verbal agreements, implied commitments, or informal understandings will not be considered valid without formal written confirmation.

Clients will receive an invoice within 24 to 48 business hours following service engagement or delivery, depending on the terms of the agreement. Payment is due within ten (10) calendar days of the invoice date unless otherwise specified in a signed contract. All payments must be made in U.S. dollars using one of the approved payment methods noted on the invoice. Tucci Rue LLC reserves the right to pause or terminate services in the event of nonpayment or repeated delays in payment.

If payment is not received by the due date, late fees will be applied as follows: a 10% late fee will be added at 10 days past due; a 20% late fee will apply at 20 days; and a 40% late fee will apply at 30 days. If an invoice remains unpaid for more than 40 days, the account will be referred to collections, and an early termination fee equal to two (2) times the original service cost will become immediately due and payable. Tucci Rue LLC reserves the right to pursue all legal remedies available for the recovery of unpaid fees, including the collection of legal and administrative costs.

For clients enrolled in recurring services, subscriptions, or retainer-based engagements, written cancellation must be submitted before 50% of the current billing cycle has passed to avoid automatic renewal. If cancellation occurs after this threshold, the client will be billed in full for the upcoming billing period. No prorated refunds or credits will be issued once a billing period has begun, regardless of whether the services were fully utilized.

All sales, deposits, and payments are final. Tucci Rue LLC does not offer refunds, partial credits, or adjustments for unused services, regardless of client decision, hiring outcome, or change in business circumstances. Clients explicitly waive the right to initiate chargebacks through their bank, credit card provider, or payment processor. Any unauthorized chargeback attempts will result in immediate termination of services, forfeiture of any remaining deliverables, and potential legal action for recovery of outstanding amounts, damages, and related costs.

Tucci Rue LLC may use digital platforms, software tools, and AI-assisted technologies in the delivery of services. This may include CRM platforms, scheduling tools, video interview software, transcription services, note-taking apps, reporting dashboards, and generative AI tools to support evaluation summaries, communication drafts, and internal documentation. By engaging with our services, clients consent to the responsible and ethical use of such tools to enhance the efficiency and effectiveness of service delivery.

By engaging with Tucci Rue LLC and submitting payment, clients acknowledge and accept these billing terms in full and agree to abide by them for the duration of the engagement.

Account Access, Passwords, and Security

If digital access, shared platforms, or password-protected resources are provided as part of a Tucci Rue LLC service engagement, clients are solely responsible for maintaining the confidentiality and security of their login credentials. Password sharing, account duplication, or unauthorized access by unapproved parties is strictly prohibited. Tucci Rue LLC reserves the right to monitor usage and immediately suspend or terminate access in the event of any unauthorized use, sharing of credentials, or suspected security breach. Any misuse or unauthorized distribution of access may result in immediate service termination and, if applicable, legal action to protect Tucci Rue LLC’s intellectual property, client data, and operational integrity. Clients agree to notify Tucci Rue LLC immediately of any suspected compromise of credentials or unauthorized access.

Business Closure, Acquisition, or Sale

In the event that Tucci Rue LLC ceases operations, clients will be notified in writing at least thirty (30) days in advance. During this notice period, clients will be given the opportunity to download any final reports, evaluations, or deliverables associated with their engagement. After this window, Tucci Rue LLC may permanently deactivate accounts and delete data in accordance with applicable privacy and data retention policies.

If Tucci Rue LLC is acquired or undergoes a sale or merger, the acquiring party will assume all service obligations under the existing terms at the time of acquisition. Clients will receive notice of the change and will have the opportunity to review and accept the acquiring party’s updated terms. If the client chooses not to continue under new terms, they may cancel their engagement without penalty. Any transfer of data in such an event will be handled securely and in full compliance with relevant data privacy laws and contractual obligations.​

Industry Data and Research Acknowledgment

To support the accuracy and relevance of the hiring metrics, performance data, and cost benchmarks referenced in our website, service descriptions, and marketing materials, Tucci Rue LLC relies on publicly available research and third-party industry reports from the following reputable sources: U.S. Department of Labor, Gallup, Society for Human Resource Management (SHRM), Harvard Business Review, Glassdoor, LinkedIn Talent Solutions, Brandon Hall Group, Zippia, CareerBuilder, and Sales Benchmark Index (SBI). While these sources are trusted and widely recognized, all insights and figures shared by Tucci Rue LLC are intended for general informational purposes only. Results may vary depending on each client’s unique situation. Tucci Rue LLC makes no guarantees regarding the applicability, completeness, or accuracy of third-party data in any specific use case. By using our services or engaging with our materials, clients accept full responsibility for any decisions made based on this information.

General Provisions

Tucci Rue LLC reserves the right to suspend, pause, or permanently terminate services at its sole discretion if the client violates any portion of these Terms and Conditions, engages in unethical or unprofessional behavior, fails to meet agreed-upon payment obligations, or does not participate in the interview process in good faith. Such actions may also result in the forfeiture of any pending deliverables or access to services without refund.

By using our services, completing an engagement form, accessing candidate evaluations or deliverables, or otherwise participating in any part of the Tucci Rue LLC service model, the client confirms full acceptance of these Terms and Conditions. Continued use of our services constitutes a legally binding agreement to the latest version of these terms.

​

Tucci Rue LLC reserves the right to update, revise, or modify these Terms and Conditions at any time without prior notice. Any updates will be reflected on our website. Continued use of services following any updates indicates acceptance of the revised terms.

​

These Terms and Conditions represent the complete and exclusive agreement between Tucci Rue LLC and the client and supersede all prior oral or written understandings, proposals, discussions, or agreements.

​

Tucci Rue LLC shall not be held liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, illness, pandemics, internet outages, cyberattacks, government actions, labor disputes, system failures, or other events of force majeure. In such events, Tucci Rue LLC will make commercially reasonable efforts to resume services as promptly as possible, but will not be liable for any resulting delays or disruptions.
